Credit Agreement
Customer warrants that the information herein is based upon a thorough investigation of customers records and is true and correct in all respects and are made for the purpose of establishing a line of credit with Pasture to Plate, Inc. Pasture to Plate, Inc. is hereby authorized to obtain any information from any source concerning the statements contained in this application considered necessary. It is understood by customer that Pasture to Plate, Inc. shall make extensions and renewals of credit relying upon this report and customer agrees to immediately notify Pasture to Plate, Inc. in writing of any material changes in customers financial status as reported herein as Pasture to Plate, Inc. will continue to rely on this information for financial decisions relating to customer based on this information as updated from time to time.
It is understood and agreed that all charges are to be paid to Pasture to Plate, Inc. at 5105 West Ogden Avenue, Cicero, IL 60804. Customer agrees to pay for any and all deliveries under and pursuant to its accounts, whether ordered by the customer or by any person representing himself/herself/itself to be an agent, employee or representative of the customer. The signature of authorized personnel of your company or organization constitutes an acceptance of these conditions at time of delivery. Any person in your employment at time of delivery, signing on behalf of your company or organization shall be considered authorized personnel. Claims of any kind must be made within 24 hours of receipt of goods. All unsatisfactory goods must be held under refrigeration before returning to our plant unless disposition other than returning is authorized by our sales manager. No credit will be allowed for products disposed of without authorization from our sales manager.
Credit terms are at the absolute discretion of Pasture to Plate, Inc., who may terminate, alter or deny credit terms at any time without notice and without cause. All sales on credit are made according to the terms stated on the invoice, unless otherwise specified and approved by Pasture to Plate, Inc. All past due accounts accrue interest at 1½% per month which is an Annual Percentage Rate of 18% on the unpaid balance, or at the legal rate of interest, whichever is less. The accrual of payment of interest does not authorize the customer to defer payment of any indebtedness beyond the credit terms stated herein. In the event of delinquency of any account, customer agrees to pay all collection costs, attorneys fees, and court costs incurred in the collection of said account, regardless of whether judicial action is undertaken. Customer further agrees to pay $30.00 for each check returned for lack of sufficient funds, uncollectable funds, or postdated checks.
Applicants signature attests financial responsibility, ability, and willingness to pay our invoice in accordance to the above terms.
Should credit be granted, the undersigned hereby personally guarantees payment of all present and future debts owing to Pasture to Plate, Inc.
